1. Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Client", "you", "your") and Crescent Buildtech ("Company", "we", "our", "us"), having its registered office at 561, Ground Floor, 36th Block, A Cross, 5th Phase, Yelahanka New Town, Bengaluru — 560064, Karnataka, India.

By accessing our website at crescentbuildtech.com, submitting an enquiry, or entering into a service agreement with us, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are acting on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.

2. Our Services

Crescent Buildtech provides the following services in Bengaluru and surrounding areas:

• Architectural Design and Construction — Turnkey civil planning and construction for residential and commercial projects.
• Landscape Designing — Outdoor space planning, design, and execution.
• Elevators Sales & Service — Supply, installation, and maintenance of residential and commercial elevators.
• Interior Design and Execution — End-to-end interior design, material selection, and implementation.

The scope of any specific service is defined in a separate written agreement, work order, or contract signed between the Company and the Client prior to commencement of work.

3. Enquiries & Quotes

Submitting an enquiry or requesting a quote through our website, phone, email, or WhatsApp does not constitute a binding contract. It is an invitation to discuss your requirements.

• We aim to respond to all enquiries within 24 business hours.
• Any quote or estimate provided is indicative and based on information supplied at the time. Final pricing is subject to a detailed site assessment and formal quotation.
• Quotes are valid for 30 days from the date of issue unless otherwise stated.
• Prices quoted are exclusive of GST unless expressly stated otherwise.

4. Project Agreements & Contracts

All construction, design, or service engagements are formalised through a written project agreement or contract that will include:

• Detailed scope of work
• Project timeline and milestones
• Payment schedule linked to milestones
• Material specifications and package details
• Warranty terms applicable to the specific service

Work will not commence until the project agreement is signed by both parties and the advance payment as specified in the agreement is received.

Any verbal representations made during discussions are not binding unless incorporated into the written agreement.

5. Payments & Pricing

5.1 Payment Schedule

Payments are milestone-based and set out in the project agreement. Typical milestones include foundation completion, superstructure, roofing, finishing, and handover. Exact milestones are project-specific.

5.2 Late Payments

If any payment is not received within the due date specified in the agreement, Crescent Buildtech reserves the right to:

• Suspend work on the project until payment is received.
• Charge interest on overdue amounts at the rate of 1.5% per month from the due date until the date of payment.

5.3 GST & Taxes

All applicable Goods and Services Tax (GST) and other statutory levies will be charged in addition to quoted prices as per prevailing Indian tax law. Tax invoices will be provided for all payments.

5.4 Advance Payments

Advance payments made by the Client are non-refundable if the Client cancels the project after work has commenced, except where the Company is found to be in material breach of the agreement.

6. Timelines & Delays

We are committed to on-time delivery and set realistic timelines in our project agreements. However, the following may result in schedule adjustments without liability to the Company:

• Delays in Client approvals, design decisions, or payment releases
• Changes or additions to the scope of work requested by the Client
• Monsoon season, adverse weather conditions, or natural disasters
• Delays in supply of materials due to market conditions or supply chain disruptions
• Government-mandated shutdowns, regulatory delays, or force majeure events
• Site access restrictions or third-party contractor delays

We will notify the Client promptly of any anticipated delays and provide a revised schedule.

7. Changes & Variations

Any change to the approved scope of work ("variation") must be:

• Requested in writing by the Client (email is acceptable)
• Assessed and quoted by Crescent Buildtech
• Approved in writing by the Client before implementation

Variations may affect the project timeline and cost. Crescent Buildtech will not be liable for delays arising from unapproved or undocumented variations.

8. Intellectual Property

All architectural drawings, design documents, 3D renders, and other creative works produced by Crescent Buildtech in connection with your project remain the intellectual property of Crescent Buildtech until full and final payment has been received.

Upon receipt of full payment, the Client receives a licence to use such materials for the specific project only. Crescent Buildtech retains the right to use photographs, drawings, and project details for portfolio, marketing, and promotional purposes, unless the Client objects in writing.

All content on the Crescent Buildtech website — including text, images, logos, and design elements — is owned by or licensed to Crescent Buildtech and may not be reproduced, distributed, or used without prior written permission.

9. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

• Crescent Buildtech's total liability to the Client for any claim arising out of or in connection with a project shall not exceed the total amount paid by the Client to Crescent Buildtech for that specific project.
• We shall not be liable for any indirect, incidental, consequential, or special loss or damage (including loss of profit, revenue, or business opportunity) arising out of or in connection with our services or these Terms.
• Crescent Buildtech is not responsible for defects caused by Client-supplied materials, Client-directed design decisions, or third-party products installed at the Client's request.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

10. Disputes

In the event of any dispute arising out of or in connection with these Terms or any project agreement, the parties agree to first attempt to resolve the matter amicably through good-faith discussion within 30 days of either party notifying the other of the dispute.

If the dispute cannot be resolved amicably, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be Bengaluru. The arbitration shall be conducted in English by a sole arbitrator agreed upon by both parties.

The arbitral award shall be final and binding on both parties.

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to the arbitration clause above, the courts of Bengaluru, Karnataka shall have exclusive jurisdiction over any dispute arising out of these Terms.

12. Website Use

You agree to use the Crescent Buildtech website only for lawful purposes. You must not:

• Use the website in any way that violates applicable Indian laws or regulations.
• Attempt to gain unauthorised access to any part of the website or its underlying systems.
• Transmit any unsolicited commercial communications, malware, or harmful code.
• Scrape, copy, or republish website content without written permission.

We reserve the right to suspend or terminate access to the website for any user who violates these conditions.

While we take care to ensure accuracy, the website is provided "as is" and we do not warrant that it will be error-free, uninterrupted, or free of viruses.

13. Amendments to These Terms

Crescent Buildtech reserves the right to update or modify these Terms at any time. Changes will be posted on this page with a revised "Last Updated" date. It is your responsibility to review these Terms periodically. Continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.

For ongoing project agreements, the Terms in force at the time the agreement was signed shall continue to apply unless both parties agree in writing to the updated Terms.
